SAN FRANCISCO (KRON) -- A 29-year-old driver with multiple previous DUI convictions was charged with murder after a fatal pedestrian crash in San Francisco's Excelsior District earlier this month, District Attorney Brooke Jenkins announced Tuesday.

David Maldonado Sanabria was also charged with driving under the influence of alcohol causing injury with allegations of a blood alcohol level of over 0.15% and refusing a chemical test. Additionally, he is accused of leaving the scene of a crash.

On Oct. 1 around 7:05 p.m., a 43-year-old man was walking inside a crosswalk at the intersection of Moscow Street and France Avenue when he was hit by a truck being driven by Maldonado Sanabria, according to investigators. After the man fell backwards onto the pavement, Maldonado Sanabria allegedly slowed down to look at the victim before driving away.

A witness who saw the incident pursued the truck driver and took a photo of the license plate, Jenkins said. The photo, along with automated license plate reader cameras, helped San Francisco Police Department officers locate and arrest Maldonado Sanabria 3 miles away from the collision.

The victim was rushed to the hospital in critical condition. On Oct. 19, SFPD was informed that the victim succumbed to his injuries caused by the crash.

“This is a tragedy,” Jenkins repeated at a news conference Tuesday. “This man was just over 40 years old who died. And lost his life just walking down the street.”

Jenkins said Maldonado Sanabria has two prior DUI convictions, which allow her office to charge him with murder in this case.

Maldonado Sanabria is scheduled to be arraigned at 1:30 p.m. Tuesday. The DA’s office is seeking to have him detained without bail pending trial.
